WHO PAYS THE JUDGMENT?
In Florida, when an auto accident case is presented to a jury, the Defendant is almost always backed by an insurance company. However, the law prohibits the jury from knowing anything about the at fault party's insurance. In fact, the jury is not even allowed to know which insurance company is backing the Defendant or how much coverage is available. Throughout the trial the jury is kept in the dark as to who really is financially responsible for paying the jury's verdict. Only after the jury announces their verdict and the judge sends them home is the Plaintiff allowed to have the insurance company added to the lawsuit. See 627.4136, Fla. Stat.
